Modern Spare warrants that all spare tires and complete spare tire kits will fit the vehicle specified and notated on the original order for five years from the date of order shipment. If you encounter a fitment issue, Modern Spare will provide a solution to the fitment prevention issue. This may include one or more of the following efforts to rectify the fitment issue: providing a replacement spare wheel, assisting you with the proper use of the product, or providing other reasonable solutions to enable safe, normal use of your spare.
The fitment guarantee covers only what is defined as “fitment.” The coverage applies to the following defined fitment descriptions:

Modern Spare shall not be liable for any costs, expenses, or damages incurred as a result of improper installation, use, or fitment issues related to any products sold. It is the responsibility of the purchaser to ensure that all products are installed and used in accordance with the manufacturer’s specifications and instructions. This includes but is not limited to ensuring proper fitment of spare tires or wheels, correct installation of tools, and adherence to safety guidelines. Any expenses arising from towing, labor, installation, or incidental or consequential damages are expressly excluded from coverage under this warranty and guarantee policy. This provision that excludes liability or compensation of costs, expenses, or incurred damages applies equally in the event that it is determined that the seller provided a non-fitting product based on the fitment definitions defined under the covered definitions of fitment.
Modern Spare warrants that the alloy wheel component of your spare tire assembly is free from defects in material and workmanship for the lifetime of the wheel. This warranty applies to the original purchaser and for the intended use of the wheel on the specific vehicle model declared in the warranty registry or in the Year, Make Model field of the order form.

All warranty and guarantee provisions in this policy are based on Modern Spare products sold in and delivered in the 48 contiguous US states. For order shipped outside of these generally recognized 48 contiguous states, Modern Spare may, at its discretion, honor all warranties and guarantees with the exception of associated shipping charges associated with product replacements or other remedies associated with the policy.
THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Exclusive Remedy
THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR REPAIR OF THE PRODUCT, AT THE SOLE OPTION OF MODERN SPARE. MODERN SPARE SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SALE, USE, OR PERFORMANCE OF THE PRODUCT, WHETHER BASED ON STRICT LIABILITY, CONTRACT, TORT, OR OTHERWISE.
Severability
IF ANY PROVISION OF THIS WARRANTY IS HELD TO BE INVALID OR UNENFORCEABLE, SUCH PROVISION SHALL BE STRUCK FROM THIS WARRANTY AND THE REMAINING PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.
Governing Law
THIS WARRANTY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF UTAH.
Dispute Resolution
ANY DISPUTE ARISING OUT OF OR IN CONNECTION WITH THIS WARRANTY SHALL BE RESOLVED THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION.
Notice of Breach
THE PURCHASER MUST GIVE MODERN SPARE WRITTEN NOTICE OF ANY BREACH OF THIS WARRANTY WITHIN THIRTY (30) DAYS OF THE DATE OF DISCOVERY OF SUCH BREACH.
Remedy Selection
THE PURCHASER MUST CHOOSE ONE OF THE REMEDIES PROVIDED IN THIS WARRANTY. THE PURCHASER MAY NOT SEEK MULTIPLE REMEDIES FOR THE SAME BREACH.
The Modern Spare return policy has a duration of 30 days from the date the item has shipped (regardless of the order date). If 30 days have passed since your package left our facility based on carrier tracking records, unfortunately, we are unable to offer a refund or return option.
Returns will be subject to non-refundable shipping costs of both the original shipping and return shipping. Your refund will reflect the full purchase price minus these associated shipping costs.
To be eligible for a return, your item must be unused, complete, and in the same condition that you received it.
To initiate a return, we will need to verify your order. Please provide your name and any identifying order details, such as your order number. Email them to helpdesk@modernspare.com along with your request for a return. Please indicate the reason for your return.
Please do not send back an item before sending this info and receiving a return authorization reply from Modern Spare customer service. Rejecting a shipment upon delivery is not sufficient to facilitate your returned item. The buyer is responsible to provide tracking information on the return either from the return shipping provided by Modern Spare or from a carrier you choose to transport the returned package.
Once a return has been approved, the returning parcel must be in the possession of the return carrier within 14 days and be trackable.
In certain situations, only partial refunds are granted (if applicable).
There are no charges if you choose to cancel an order before it is processed for shipping. However, if you choose to cancel the order after the order is processed for shipping a tracking number is generated, and before it is delivered to you, Modern Spare will attempt to have the shipping carrier recall the package. If we are successful in recalling the package, the refund amount will reflect the full purchase price minus the outbound shipping charge. If we cannot have the package recalled and it is delivered to you, please follow the normal process of requesting an order return.
Once your approved return is received, it will be inspected. You will receive an email to notify you that your refund has been processed and will have details on the amount and outcome of the return inspection.
Modern Spare is only able to issue refunds being applied to the original payment method and card used. Please allow up to 7 business days for this credit to appear in your bank account or on your credit card after the refund email is received from Modern Spare.
Instances where only partial refunds are granted (if applicable)
Please note – The return process requires a critically important repackaging standard to be maintained. Take care to have all accessories (jack, tools, etc.) packaged adequately so that no contact is made with the wheel’s finish during transport. If a spare wheel is returned scratched or damaged, a value assessment will be made during inspection once received. This value assessment will be deducted from any due refund.
If an order is shipped and then returned to Modern Spare due to the carrier (shipping service) being unable to deliver the item as a result of provided address clarity issues or the parcel being unclaimed after delivery attempts are made, the original price paid will be refunded minus the cost of shipping. If this situation has arisen with your order, please contact Modern Spare. We will gladly work to find a solution and get the matter resolved.
Once an item ships, you will be offered management control of the shipping process if your parcel is shipped via FedEx Ground (our default Cont. US shipper). The tracking number and corresponding link provided will enable you to alter the delivery requirements. Examples include- signature requests, redirects of parcels to holding facilities, etc. These options will vary by carrier. Many of these options are NOT default options and must be requested using the tracking link to the carrier website.
If you haven’t received a refund as expected, we ask that you first check with your bank or credit card company. Often, a return credit can take up to 7 business days to be posted.

For international orders, your home country may have import duties and taxes associated with the purchase of spare tire kits and other products we offer. As each country has different customs requirements, be aware that it is the responsibility of the purchaser to pay the fees being charged by your home country. These charges may be due before or even after delivery and generally are paid to the delivery carrier.
If an international order is shipped and returned due to the carrier being unable to deliver the item as a result of address clarity or the parcel being unclaimed after delivery attempts are made, the original charge will be refunded minus the cost of shipping. If this situation has arisen with your order, please contact Modern Spare. We will gladly work to find a solution and get the matter resolved.
We only replace items if they are defective or have received damage due to shipping. If you need to exchange a product that is defective or damaged in shipping, send us an email at info@modernspare.com. Once your exchange request has been approved and initiated we will then send details for your return shipment. If an item was ordered by mistake, such as a kit for an incorrect car model, Modern Spare can assist you with rectifying the situation and may guide you through the process of obtaining the correct item. In some instances, only a portion of the spare tire kit will need to be altered.
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, the refund will be applied to the original purchaser. This will, in turn, notify the original purchaser (gift giver) that a return was processed.
Normal In-stock orders
All transaction charges to your chosen method of payment are processed at the time the order is placed. We make every effort to have the product shipped by the estimated ship date shown on your order confirmation. We make efforts to notify you of unexpected delays with options of keeping your order in place. You do have the option of canceling orders that have not shipped.
Back Order Or Pre-order products
We will offer kit options as pre-orders if a kit is near the final stage of development. This allows you to secure an order for an upcoming release. Although the Pre-order process will capture your credit card information if you choose to provide it, no charge will be applied to your card at that time. At the time of release or when the product is available for shipment, we will attempt to notify you to inform you that your order will be processed. Once confirmed, the card will be charged, and your order will then be considered a normal order.
If we forecast delays in inventory supplies, we will offer a backorder option. Just like the pre-order option, you can provide the card and payment information to reserve your purchase; however, no charge will be applied at that time. Once the product is available and ready to ship, we will attempt to notify you before a charge is processed. Once you confirm the order can proceed, the card will be charged. The order will then be processed as a normal order.
We do not store or have access to card information. Payment and card information is kept secure by Stripe Card Processing, which allows us to process the card once the product is ready to ship.
A pre-order or backorder is intended to provide a convenient method of securing a future order for items not yet in stock. A pre-order or backorder is not considered an actual order until we have confirmation from you to proceed and we have applied a charge to your payment method. If you have a preorder or backorder in place, please be watchful for email notifications in order to confirm the order can proceed.
Shipping costs are non-refundable. As stated in the return policy, refunds will reflect the original purchase price minus associated shipping.
In almost all situations, when requesting a return, it will be less expensive for customers to have Modern Spare book your return shipment and provide you with a pre-paid return shipping label.

If you purchase your own return shipping, your refund will reflect the purchase price minus the original outbound shipping. This will be reflected in your refund details. Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are shipping an item over $75 in value, we recommend using a trackable shipping service or purchasing shipping insurance. We cannot guarantee that any item that you ship will successfully be delivered to our warehouse.
